Conditions for selling tickets online
These conditions of sale apply ipso jure and without restriction to all orders placed on the website https://parc-phoenix.tickeasy.com of the city of Nice, headquartered at 5, rue de l'Hotel de Ville 06364 Nice cedex 4. They are subject to change without notice. The purchase of entrance tickets to the Parc Phoenix by the customer implies his unconditional acceptance of these conditions of sale.
These conditions apply to the exclusion of all other conditions of sale, in particular those in force for sales on site.
The customer declares to have the capacity to conclude this contract, that is to say to have the legal majority and not to be under tutorship or curatorship.
Important: if you forget the proof of purchase, tickets cannot be delivered on site at the reception of the Parc Phoenix, and access to the site will be refused to the customer. In any case, we invite you to check your e-mail before going to the park reception.
Article 1 - Price and number of entry tickets
1.1 Ticket prices are indicated in euros including taxes. They are displayed at the entrance to the Parc Phoenix in the city of Nice. In the event of partial closure of the site, works, reduction in opening hours, the prices remain unchanged.
1.2 Only individual tickets at full price, reduced price (children from 12 to 18 years old, students and holders of the Nice Museums Pass card) and free (children under 12) are offered for sale for a validity of 7 days on the website of the city of Nice.
Individual reduced or free tickets purchased on the internet must be presented at the entrance to the park, along with the relevant supporting documents (identity card, family booklet, student card, Nice Museums Pass card).
1.3 Visitors or groups of visitors likely to benefit from another reduced rate or from another gratuity than those mentioned in article 1.2 (entry fee rates available on http: //www.parc-phoenix. org, or on request at the email address parcphoenix@ville-nice.fr) must obtain their ticket on site by presenting an identity document and / or supporting documents.
1.4 All orders, whatever their origin, are payable in euros.
1.5 The applicable prices are the current rates on the day of the order, although the city of Nice reserves the right to modify its prices at any time. Entrance ticket sales will be billed based on rates in effect at the time of order purchase.
1.6 Tickets sold on the internet do not constitute a skip-the-line.
Article 2 - Modification of order
The "Mon panier/My basket" area allows you to verify that the order placed corresponds to your wish. As long as the payment has not been saved, you can modify the content of your order on the "Mon panier/My basket" page.
For any cancellation request after validation of the transaction, see article 9 below.
Article 3 - Information on tickets sold
A ticket is sold for a passage within 7 days. It is up to the customer to check on the site http://www.parc-phoenix.org and / or on the official Facebook page of the site @ parcphoenix06 on the days when the phoenix park is closed.

Article 4 - Payment
4.1 Payment by credit card allows you to buy your tickets online and at any time. The cards accepted for the payment of an order are the following:
• Carte Bleue / Visa / VPAY / Electron / Mastercard / Maestro
4.2 The city of Nice has the obligation to establish, in duplicate, a proof of transaction comprising:
• the date, time, subject and amount of the transaction
A copy will be sent to you by email.
The second copy will be kept for one year by the Parc Phoenix revenue agency.
Article 5 - Securing of payments and personal data
5.1 Payment security

The city of Nice has entrusted its payment system to a service provider specializing in securing online payments, guaranteeing complete confidentiality of the bank information which will be communicated to it.

The collection of your data - necessary for the processing of your order - is based on your consent which you can withdraw at any time by contacting the city of Nice.

The processing of your data which you have entered on an optional basis is also based on your consent which you can withdraw at any time.
The recorded data is reserved for the use of the Parc Phoenix service only for the purposes defined above and is kept for one year. The recorded data can only be communicated, if necessary, to the public accountant, subject to compliance with data protection rules.
In accordance with European Regulation 2016/679 of April 27, 2016 on data protection, and the amended Data Protection Act of January 06, 1978, you can access your data and request their rectification and erasure. Article 6 - Validation
You declare that you have read these general conditions of sale before placing your order and that you have accepted them. The validation of your order therefore implies acceptance of these general conditions of sale.
Unless proven otherwise, the data recorded constitutes proof of all transactions made by the city of Nice (revenue management of the Parc Phoenix) and its users.
Article 7 - Confirmation of the order
Your ticket order is definitively confirmed and commits the city of Nice only upon receipt by the customer of the email sent by the contact center confirming that the order has been validated.
Consequently, we invite you to consult your e-mail.
On the other hand, the archiving of orders and payment receipts is carried out on a reliable and irreversible support so as to correspond to a faithful and durable copy.
Article 8 - Obtaining tickets
8.1 - The method of obtaining tickets is described below.
Step 1: Select the ticket chosen.
Step 2: Proceed with the choice of the date of the visit.
Step 3: Choose the quantity of tickets you want.
Step 4: Add to check-out basket and check the contents of your basket.
Before definitively registering the order, the customer will have the possibility to check his selection and may modify it at his convenience.
Step 5: Proceed to your identification and registration on the site.
To place an order, each customer must be identified after having previously created a secure account with identifiers (login and password).
Step 6: Make your payment by entering your credit card number on the page http://parc-phoenix.tickeasy.com
The order will not be definitively registered until the last validation of the order screen. Consent is indicated by a double click (two mouse clicks): The first click validates your order, the second click definitively confirms your order after having checked it and, if necessary, corrected it. In the absence of a double click or information on the payment obligation, the sale is considered void. This last click is equal to the handwritten signature. From this click, the order is considered irrevocable and can only be questioned in the cases provided for herein.
Step 7: Receive the order confirmation acknowledgment. By keeping this email and / or printing it, the customer has proof of his order that the city of Nice advises him to keep. The tickets purchased will be sent to the customer, by e-mail, as an attachment in PDF format. If you do not receive the items, check your spam.
Step 8.2- For any payment, the debit is made upon validation of the order on the site of the city of Nice. The debit of the bank card is independent of the printing of tickets.
Step 8.3 - The proof of payment is sent to the email address you indicate during the order process.
Article 9 - Cancellation and reimbursement
9.1 - A ticket cannot be refunded, returned or exchanged. A ticket cannot also be resold at a price higher than that of its value numeral.
9.2 - In accordance with article L 221-28 of the Consumer Code, no right of withdrawal is exercised on this category of products: leisure and show ticketing can neither be returned nor exchanged according to the regulations applied on this type of product. Also, the order once validated, is firm and final and cannot be the subject of any refund.
9.3 - Any dispute, whatever its nature, must be made in writing to Customer Service (whose contact details are in article 10 below) no later than the day of the visit.

Article 11 - Responsibilities
You must verify the ticket (s) and the confirmation of the online purchase when they are issued or received in your email. You are solely responsible for the use by yourself or by a third party of the tickets sold.
The city of Nice cannot be held responsible for any non-performance which may arise from a case of force majeure, beyond its control, including in particular, cases of interruption of transport, strike, exceptional weather conditions, fire, etc.
Each visitor must comply with the visitor regulations posted at the entrance to the Parc Phoenix of Nice.
The visitor undertakes to comply with any instructions communicated by the Parc Phoenix concerning the organization of their visit. The city of Nice reserves the right to refuse access to any person whose attitude, behavior or comportment could be deemed likely to create disturbances inside the park, to hinder visitors and visits. In this case, no refund may be requested by the customer who will have been refused access to the park for the reasons mentioned above.
The visitor will be held responsible for any damage, of direct or indirect nature, that he might cause during his presence in the park, whether it be with regard to staff, customers or property. present in the site visited.
Finally, the city of Nice can in no case be held liable in the event of loss or theft of a ticket. No duplicate may be issued on the spot.
Reproduction right: any reproduction or use of the image of the Parc Phoenix or of an exposed work must be subject to a prior request and will be subject to the authorization of the city of Nice.
Article 12 - Applicable law - Disputes
The ticket sales referred to in these General Conditions of Sale are subject to French law.
In the event of difficulties in the interpretation or application of these conditions, the parties will try as far as possible to settle their dispute amicably. In the event of disputes, all disputes to which these conditions of sale may give rise must be brought, even in the event of a plurality of defenders or a call for warranty, before the competent court in Nice.
